Sebastian M • 22 May 2024

Guten Tag

My name is Sebastian M., 35 years old, chilean, living in Berlin since 2016.
I have a 6 years old Daughter, British. (she was born in Berlin 01.04.2018 but took the nationality of her mother, Scottish) She is going to Kita and has already a a place for a primary school.
We live separate with her Mother, but we share custody almost 50% and 50%.

After Brexit they are trying to kick 3 of us out of Germany...

Two weeks ago, 8th Mai I had a trial and they denied even to give me a Duldung, my Daughter still here in Berlin and her mum did apply for another Aufenhaltstitel...but they want me to bring my passport to the Auslanderbehörde and then give me 3 moths to leave Germany.

I have until 8th June to appeal. so Im looking for a Lawyer who can take my case as soon as possible... If you could give me some guidance to where to go. which lawyer could take this case. I can provide every document I have.

I spoke to Violeta about this and she gave me this contact.

I appreciate any help.

Kind Regards
Sebastian

Hello Sebastian M, thank you for reaching out to us. I am sorry to hear about your situation. I will try and help you as best as possible.
You mentioned that you already have had a trial, did you already have a lawyer representing you, what was their advice after the trial?
As far as I understand your question you are currently looking for a new lawyer, is that correct
Have you already tried to reach out to counselling centers like the Willkommenszentrum in Berlin? They also offer legal advice.
They also offer translation in Spanish on Thursdays: https://www.berlin.de/willkommenszentrum/ueber-uns/mehrsprachige-beratu…
Would be great if you can get back to me on these questions in the meantime I will also do some more research and give you additional information as soon as possible.
Best wishes

Hello Yara, I appreciate your quick answer.

I have a lawyer who took my case, whatever he did has being refused (I have all the documents).
After reading the last decision of the court, I’m not happy at all with his work. that’s why I’m looking for another lawyer, which would have more experience in this type of case.

I went today to KuB and they said they can not help me. They gave me a list of lawyers and they said I should to AWO.

I called to AWO, they said they are not lawyers, They can not help me but they will ask if I could get a Termin with someone there…

I would appreciate any further guidance. I have until 8th June to appeal.

Kind Regards.

Hello Sebastian M, thank you for your feedback.

Since you have a deadline that is coming up soon, I would suggest first to see with your lawyer what he would suggest. Have you talked to him about appealing this decision?
Here is also a list of lawyers that you can search for in Berlin https://www.berlin.de/special/finanzen-und-recht/adressen/rechtsanwalt-…
As well as a list of lawyers that work with the welfare organisations: https://adressen.asyl.net/rechtsberaterkonferenz/

Best wishes

Hello Yara

Thank you for your messages.

Unfortunately I was not able to get a lawyer. The one I had, said its not necessary to appeal, because they will denied anything anyway...However I want to appeal anyway, But his is on holidays, so he can not do it.
Im looking urgently for a lawyer how can make this appeal before the 15 Jun.

I already send an email to Härtefallkommission and Im waiting for an answer.

I will keep you updated.

Best Regard
Sebastian Medina
