Travel to home country

gazimi • 26 June 2024

I came to Germany according to paragraph 22. I did not applied for asylum and I have three year residence permit. I got a  job offer from an organization in another EU country that requires travel to my home country. What should I do? Can I travel to my home country? Should I inform Auslanderbehörde?

Please answer my question as soon as possible.

Dear gazimi, thank you for your question. We has similar questions before from people who received §22 and who would like to go back to their home country. Since this residency is given on humanitarian grounds but is not a protection status it is unfortunately not that straight forward. I will do some more research and get back to you.
.
In general, you are not allowed to leave Germany for longer than 6months, otherwise your residency will automatically expire. Please keep this in mind when traveling outside of Germany.

Dear gazimi,  thank you for you patience, I have the following information for you:

 It could lead to serious problems if German immigration office or other authorities receive the knowledge that you have returned to Afghanistan, it is likely that your residence permit will be revoked, that means you could lose your residency. This is because you have received this residency because you were no longer safe in Afghanistan.

.
If the reason for your return is for example to receive your transcript for your future job, then you could ask your former employer to receive the reference.
With your current residence you are allowed to work in Germany and after a certain time you can also receive a permanent residence.
If you are struggling to find a job in Germany, I saw that you have an MBA and more than 10years of experience in project support.

Dear Yara _Community Manager , Thank you for the information. It is sad that I have to decline the job offer because of the restrictions. It has been a long time, I am trying to find a job that align with professional background but unfortunately without success. My degree is already recognized here and I have German language B2 DTB telc certificate. Regarding the purpose of the travel, as I mentioned earlier. I am not traveling for personal reasons. Recently, I had an interview with an international NGO in Amsterdam and they are likely to offer me a position that requires travel specifically to African countries and Afghanistan for project monitoring and compliance purpose. I have one more question. if they accept me without travel requirement to Afghanistan can I work with my current residence permit in Amsterdam? It will be three days in the office and two days work from home. best;

Hello gazimi, as far as I know with your residency you can unfortunately, not receive an EU Blue Card
You can however with you residence permit work in Germany. After 5 years, if you full fill the requirements you can also receive a permanent residence.
Maybe Match Talent can further help you receive a job offer here in Germany.
Best wishes
