New Citizenship Law Germany

tsoverall • 10 January 2024

With the reform of Germany's citizenship law expected to come into force in April 2024, how do people that currently have an assurance of naturalisation (Einbürgerungszusicherung) go about having dual citizenship?

Upon issuance of the naturalisation assurance, the expectation is that the applicant should renounce their citizenship in order to take up German citizenship. Once the new law comes into force, what should holders of the assurance do if they want to maintain their current citizenship?

Hello tsoverall, thank you for reaching out to us. I will do some more research on your question and will get back to you as soon as possible. However, It’s good to know that if the hurdles are too high, for example you have to pay an unreasonable large amount of money to get rid of your second nationality, then authorities can make an exception.
You can find a list of when an exception can be made here: https://www.integrationsbeauftragte.de/ib-de/ich-moechte-mehr-wissen-ue…
Maybe some of these exceptions apply to you.

Hello tsoverall, apologies for the delayed response.
.
The law will likely come into effect in April of 2024, although delays are always possible. For cases that have now received an assurance of naturalization (Einbürgerunszusicherug) it depends on the individual case whether or not you can keep your current citizenship. In general, the assurance of citizenship is valid for two years. However, once the new law comes into effect the assurance of citizenship is no longer valid, since the legal situation has changed. This could become a problem if, for example, your income has dropped significantly. In such cases it is important to contact the authority/case manager and clarify to what extend the assurance of naturalization is still valid after the law changes. If the authorities refuse to do this then you should seek out legal advice.
.
In some cases, your home country allows you to reapply for your citizenship, this could also be a way to make sure that you have both citizenship. It might also be worth looking into the regulations regarding this scenario, for your home country.
Please let me know if you have further questions.
