From Language Course Visa to Skilled Work

Hi! I applied for a language course visa and hopefully, I'll be in Germany for more than 3 months so I'll have a type D visa.

My questions are, after I get the visa can I work part-time? As far as I could find out on the internet the answer is no, but I read somewhere that the new immigration law enable me to work while on a language course visa. Can you verify?

Also if I find a job (I have a uni degree and work in tech), can I switch my residence permit to blue card without having to go back to my country?

Hello rd_ck, thank you for your question on our platform. As far as I researched, you’re not allowed to work during your language course. If I receive any additional information on this, I will let you know.

However, starting from 1st of March 2024 the legislation will change and one can switch from a language course residence title to another residence title, such as the blue card. You no longer will have to go back to your country and apply for a visa there.
One can of course only make the switch if they fulfill all the requirements.
You mentioned that your work in tech. For IT professionals the following rule applies:
“IT specialists will be able to obtain an EU Blue Card if they do not have a university degree but can prove that they have at least three years of comparable professional experience. In this case, the lower salary threshold for bottleneck professions will apply (45.3% of the annual assessment ceiling; in 2024: €41,041.80)”

Hi Yara,
thank you for answering. On this website I've found contracting information:

"You cannot change the purpose of your stay" and
"Yes, since March 1, 2024, you are allowed to work in Germany with a language course visa."
I couldn't find any reference or supporting governmental document. If possible, can you please provide me the legislation allowing switching residence title within Germany? Maybe there is an extra info about working too.

rd_ck thanks for the follow up, I have doubled checked and yes, you are correct you can work up to 20hours when holding a visa for a language course.
You can find the information on the official page "The visa or residence permit for language acquisition is issued for the duration of the language course, up to a maximum of 12 months. During this time, you are permitted to work up to 20 hours per week. "

Regarding your question to switching your residency, in general the switch is possible with the new regulation. However, there are some residence titles which are excluded from this switch, for example a job search residency. In case you already know what type of residence you would like to receive it is good to prepare all the necessary requirements beforehand.

Regarding the switch to "Chancenkarte." If you apply for a visa to Germany it is usually tied to a cause, in this case language course. It is important when you arrive that you go to the immigration office and receive your residence before you can apply for a switch.
If you fulfill the requirements for the "Chancenkarte" you can also apply for that, instead of the language course visa at your respective German embassy.

Also a follow-up question, when I get the resident permit in Germany this July, can I apply for the chancekart? If so, would I receive Fiktionsbescheinigung until the Foreigner's Registration Office (dis)approves my resident permit extension as a chancekart holder?
