Family reunification

Msohraby • 8 April 2023

Hallo this is M Sohraby. I am a former local employee of Bundeswher in Afghanistan who came to Germany on 2021. After collapase of Afghanistan I with my family were evacuated to Germany under the article 22. My question is that can I get a visit visa for my mother who is in Afghanistan? My another question is that are we allowed to travel Afghanistan or its prohibited according to German law?  I will be looking forward for getting a reply.

Thanks in advance

Thanks for the infor. I already knew this solution but you may better know that for getting a german passport you have to wait for at least 3 to 5 years. I wanted to ask if there is any other solution.

Hello Msohraby, technically it is possible for your mother to apply for a visitors’ visa. For that she would have to go to the Germany embassy in Islamabad. Or the general consulate in Dubai or Istanbul. The requirements for a Visitors Vis, also called Schengen Visa, are listed here:
https://handbookgermany.de/en/visitor-visa
Please note that a visitors visa is only temporary, usually not longer than 3 months. According to the ministry of foreign affair’s website: “The applicant's willingness to return to their home country is a key requirement for the granting of any visit visa.” Unfortunately, this information is only in German: https://www.auswaertiges-amt.de/de/service/fragenkatalog-node/37-rueckk…
Some visas are rejected due to the assumption that the person will not return to their homeland. This is called rejections due to unwillingness to return. This is important to keep in mind when applying for a visitors’ visa.
For your second question: I would highly recommend that you seek expert counselling and ask them under what circumstances it is possible, if it is possible at all, to return to Afghanistan for a visit. This is important to avoid possible future problems with the immigration office. As for those who have received protection are in general not allowed to return to their home country, as this could lead to your residence status being revoked. Here you can find more information: https://handbookgermany.de/en/traveling-abroad-refugees
If you let me know what city, you are in I can search for a counselling centre near you.

I hope this answer was useful. If you have further questions please do not hesitate to ask
