Divorce and stay in Germany

The following question has reached us from the community member @2124omid:

Dear Sir or Madam:
My wife and I have been accepted into Germany's federal admission program for at-risk Afghans, and the main applicant is my wife, but she wants a divorce, so if we come to Germany and she requests a divorce, will my stay in Germany be canceled?
Please explain the changes in my stay after this incident.

Hello 2123Omid, thank you for reaching out. You're stay in Germany will not automatically be cancelled. If your residency is no longer valid in case you divorce your wife. There are options for you to continue your stay in Germany with another residency.
There is a so called independent residency, however this only applies if you have been married in Germany for three years. You can find more information on this residency here: https://handbookgermany.de/en/independent-residence-title-spouse.
Finally, applying for asylum can always be an option. Before you apply for asylum you please contact a so called "Asylverfahrensberatung" they will discuss the asylum procedure with you. I would suggest when you arrive in Germany that you seek out a counseling center that will help you take the next steps and discuss with you the different options. You can search for a counseling center using this search engine: https://bamf-navi.bamf.de/en/Themen/Migrationsberatung/
