Departure to Afghanistan

Hello, the following question reached us from a community member:

I fled from Afghanistan to Germany in 2016.

I applied for asylum and unfortunately was rejected twice.

Fortunately, I successfully completed my training as an orthopaedic technician during the time and signed an indefinite work contract, so I work as skilled worker

I have a valid national passport and stay with residence permit 19D ABS. 1 NR 1A)

The question is, can I leave Germany and stay in Kabul for a short time and come back to Germany?

Hello @anwar-w, thank you for your question. Congratulations on your successful training and on getting an indefinite work contract!

Yes, with a residence status according to §19D, paragraph 1(a) AufenthG, a trip abroad is possible. You should ensure that both your passport and your residence permit are valid for longer than your planned trip. It is recommended that both documents are still valid for at least 3 months after your planned return. Please also note that you cannot spend more than 6 months abroad unless you obtain approval from your responsible immigration office (Ausländerbehörde). After 6 months aboard without a written approval you run the risk of loosing your residence permit. You can also check with your local immigration office.

If (supplementary) social benefits are being received in your family, it is mandatory to report the absence to the Federal Employment Agency. If there are no direct flight connections, it is also very important to check the exact conditions for transit. You might need to get a visa for the transit countries. It is important that you residency is still valid when you travel, so you can come back to Germany without a problem. I would recommend it being valid for at least another 6months when you travel back to Germany.
