Bringing my would be wife to Germany

Dear Sir/Madam,

Thank you for providing us with this platform. It means a lot. 

I am Faisal from Afghanistan, came to Germany through the German evacuation program in August 2021 after the collapse of the Afghan Government since I was working for a German Organization based in Kabul, the Capital of Afghanistan. As part of this program, I already received my residence permit here in Germany but it is not still Niederlassungserlaubnis. I received C1 German Language Certificate in December 2022. Also, I did Integration Course and passed Einburgerungstest with a score of 33 out of 33. Right now,  I am working as a full-time Finance Manager here in Bremen. I have two questions:

  1. I wanted to know if I am allowed to travel back to Afghanistan with this Residence Permit before I receive my German Passport.
  2. Now I am thinking of getting married, so what requirements do I have to meet for bringing my would-be-wife to Germany? 

If it is needed, we can have a call through Zoom or whatever to discuss this issue in details.

My Nguyen_Community Managerin Thank you for your question. I came to Germany based on Paragraph 22.2. I do not understand exactly your question about the residence title. I am like a recognized migrant I think. I did neither apply for asylum nor had any interview at the court. When I entered Germany in August 2021, I received a round 18 Months residence permit, because my Afghani Passport was valid till March 2023. Now I extended my passport and next week on 19 April, I have an appointment at Migration Office. No, I have not applied for Niederlassungserlaubnis so far. Based on my information I am yet to be eligible for Niederlassungserlaubnis. I hope your question is answered. I have really limited information about the types of Residence permits and the migration process in general.

Hello Ahmad Faisal Angaar thank you for your response.
Unfortunately, with this type of residence permit it is currently very difficult and complicated, if not impossible for family reunification in general. In Germany, the fiancée does not count as an immediate family member. Therefore, there is no easy solution to bring your fiancée to Germany.
If the marriage was not already concluded in the home country, but only later after receiving the residence permit, only the foreigners department can decide at its discretion about the approval.
For now there needs to be humanitarian reasons, like health issues or a proof that your fiancée is depending on your care because no one else can.
This means the challenges are very high and often involves legal counselling. Therefore, I recommend you to consultate a
local counselling center in Bremen.

Regarding your assumption about your Niederlassungserlaubnis, this seems correct for your case. My apologies for the misunderstanding. This was due to your great achievements you've reached so far - congrats!

About your travel to Afghanistan: Since you have an appointment on April, 19th with the foreigners department, you should ask your responsible co-worker. If s:he agrees you should ask for a confirmation.

Thank you for your reply and for the information. Haha, yeah, I have done my best with the language and other necessary things. I hope I can receive the Niederlassungserlaubnis, although I am not that much optimistic. I will try and contact the counseling centers for getting the exact information about the rules and laws here in Bremen. I hope I can get enough information about my questions and concerns from my case worker.

Regarding the marriage, I can do it from here as well. Through Afghan Embassy here in Germany I can assign my Father as my power of attorney. He can sign in my marriage certificate instead of me and also we can do the other process in Afghanistan Embassy either in Tehran, Iran or in Islamabad, Pakistan.

I hope I can make it happen.
